THIS✳WKNEW YORK
TERMS OF SERVICE · EFFECTIVE SEPTEMBER 21, 2026

The agreement
behind the plans.

These Terms are a binding contract between you and THIS WK NYC. They cover the website at thiswk.nyc, the listings, your lists and gangs, member-hosted gatherings, and everything else we offer (together, the “Service”). Please read them; they include a limitation of our liability, a release for gatherings other members host, and an agreement to arbitrate disputes individually (Section 16).

The short version (the full text below controls):
  • You must be 18 or older to have an account.
  • Listings come from other people's websites and public sources, sometimes read by automated tools. They can be wrong. Confirm with the source before you go; nothing here is a ticket or a reservation.
  • Gatherings on the guest list are hosted by members, not by us. We don't vet hosts or guests. You go at your own risk and deal directly with the host.
  • Be decent: no impersonation, harassment, spam, scraping, or illegal content. We can remove content and close accounts.
  • The Service is free and provided “as is”. Our liability to you is capped at US $100 where the law allows a cap.
  • Disputes go to individual arbitration in New York unless you opt out within 30 days or your local consumer law says otherwise.

1. Who we are and how to reach us

The Service is operated by THIS WK NYC (“THIS WK”, “we”, “us”), based in New York, New York, United States. Questions, notices and legal requests go to [email protected]. THIS WK is not affiliated with, sponsored by or endorsed by any venue, promoter, ticketing service, publication, social network or public agency whose events or data appear in the Service.

2. Accepting these Terms

By creating an account, ticking the acceptance box at signup, or otherwise using the Service, you agree to these Terms and to our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, do not use the Service. If you use the Service on behalf of an organization (for example, hosting a gathering for a company or club), you represent that you are authorized to bind that organization, and “you” includes it.

We may change these Terms. For material changes we will post the revised Terms with a new effective date at least 14 days before they take effect and, for account holders, show a notice in the Service or send an email to the address on your account. Continued use after the effective date means you accept the revised Terms; if you do not, delete your account before that date. The current version is always at thiswk.nyc/terms.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to create an account or attend a gathering arranged through the Service. The Service is not directed to children, and we do not knowingly collect personal information from anyone under 18; if we learn we have, we will delete it (see the Privacy Policy). You may not use the Service if we have previously suspended or removed you, or if you are barred from receiving services under the laws of the United States or the place where you live. Browsing public listings without an account is welcome and is also governed by these Terms.

4. Your account

  1. Accuracy. Give us a working email address and keep it current. Your handle is a pseudonym; you may not use one that impersonates another person or organization, infringes anyone's rights, or is offensive.
  2. Security. You are responsible for everything done through your account and for keeping your password, invitation links, share links and reset links confidential. Tell us promptly at [email protected] if you suspect unauthorized use. We are not liable for loss caused by someone using your credentials or links.
  3. One person, one account. Do not create accounts for other people, share an account, or create multiple accounts to evade a block, a removal from a gang, or a host's decision.
  4. Verification. We may require email verification and may limit features until it is complete. We do not verify anyone's identity, age, background, or conduct.

5. What the Service is — and is not

  1. An editorial guide. We collect public event and venue information from third-party websites, APIs, public datasets, newsletters and social posts, sometimes using automated and AI-assisted tools to read, summarize, rank and personalize it. This is informational content. Dates, times, prices, availability, age limits, accessibility and cancellations change without notice and may be extracted incorrectly. Always confirm with the original source before relying on a listing.
  2. Not a seller. We do not sell tickets, take reservations, process payments, or act as the agent of any venue, promoter, ticket seller or host. Saving an event, adding it to a list, proposing it to a gang, “locking” a plan, or receiving approval for a gathering does not buy anything, reserve anything, or guarantee entry.
  3. Not a party to your plans. Lists, gangs, chat and the guest list are tools for you and the people you choose. Any arrangement, transaction, purchase or dispute between you and a venue, seller, host, guest or other member is solely between you and them.
  4. Personalization. Recommendations are automated guesses based on your stated preferences and activity. They are not advice, not comprehensive, and not endorsements; they have no legal or similarly significant effect on you.
  5. Outbound links and affiliate programs. Links to ticket and listing pages go through our redirect so we can count click-throughs. We currently earn nothing from those links. If we ever join an affiliate program, we will disclose it on the affected pages and here.

6. Member-hosted gatherings and the guest list

Members can publish gatherings and approve guests. THIS WK does not organize, host, sponsor, verify, inspect, insure or supervise any gathering, host, venue or guest. Hosts and guests are independent adults acting on their own account.

  1. If you host, you are solely responsible for the gathering: for the truth of your description, for having the right to use the space, for complying with all applicable laws and rules (including permits, occupancy limits, noise, fire and safety codes, alcohol and cannabis laws, age restrictions, accessibility obligations, tax reporting, and the rules of any building, landlord or venue), for the safety and conduct of your event, and for any money you choose to collect from guests outside the Service. You must not publish a gathering you cannot lawfully hold, misdescribe its nature, or discriminate against guests on any basis protected by law. You must keep any personal information you receive about guests confidential and use it only for that gathering.
  2. If you attend, you decide whether to trust a host. Approval is a host's personal decision and can be withdrawn at any time; it is not transferable and not a ticket. You must follow the host's reasonable rules and applicable law, keep arrival details private, and not attend without approval or bring uninvited people.
  3. Assumption of risk and release. Meeting people from the internet and attending events involves risk, including risk of injury, property loss, illness, and disappointing or unsafe behavior by others. To the fullest extent permitted by law, you assume those risks, and you release and agree not to sue THIS WK and its owners, operators, contributors and agents from and for any claim, damage, loss or injury arising out of or relating to any gathering, host, guest, venue, listing or member conduct, whether or not the Service was used to arrange it. If you are a California resident, you waive California Civil Code §1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
  4. Safety. Use ordinary care: meet in public where sensible, tell someone where you are going, and leave if you feel unsafe. For emergencies contact local emergency services (911 in the United States). The Service does not send gathering-status notifications; check your requests page and your host dashboard.

7. Your content

  1. Ownership. You keep whatever rights you have in the text and other material you submit — lists, notes, gathering descriptions, chat messages, handles, greeting names and preferences (“Your Content”).
  2. License to us. So that we can run the Service, you grant THIS WK a non-exclusive, worldwide, royalty-free, sublicensable (to our service providers only) license to host, store, back up, reproduce, adapt for display, and transmit Your Content to the people you choose to share it with, and to use it to personalize the Service for you. This license lasts as long as Your Content remains in the Service (including in the shared gangs and chat that outlive a deleted account, as described in the Privacy Policy) and in routine backups for a limited time afterward. We claim no right to use Your Content for advertising, publicity, or training AI models.
  3. Responsibility. You alone are responsible for Your Content and for having the rights to post it. Whatever you share with other members can be copied, screenshotted, or repeated by them; revoking a link or deleting a message does not undo that.
  4. Feedback. Suggestions you send us may be used without obligation to you.

8. Acceptable use

You agree not to, and not to help anyone else to:

  • break any law, or post content that is illegal, defamatory, fraudulent, obscene, sexually explicit, or that promotes violence, hatred or discrimination against any person or group;
  • harass, threaten, stalk, dox, intimidate or exploit anyone, or contact a member who has blocked you through another account;
  • impersonate any person or organization, misrepresent your affiliation, or publish misleading events or gatherings;
  • post other people's personal information (addresses, phone numbers, images, private facts) without their permission;
  • send spam or unsolicited commercial messages, or use the guest list, gangs or chat for advertising, recruitment, pyramid schemes or unrelated solicitation;
  • sell, rent or transfer accounts, invitations or approvals;
  • upload malware or links to it, or circumvent our security, CSRF, rate-limiting, access-control or consent mechanisms;
  • scrape, crawl, harvest or bulk-download the Service or its members' information, or use automated means to access it beyond ordinary browsing or search-engine indexing of public pages;
  • reverse engineer, frame, mirror, or resell the Service, or remove proprietary notices;
  • interfere with the Service's operation or impose an unreasonable load on it; or
  • use the Service to develop a competing dataset of member information.

We may investigate suspected violations and cooperate with law enforcement and rights holders as described in the Privacy Policy.

9. Moderation, suspension and termination

We may, at any time and with or without notice, remove or restrict content, decline to publish a gathering, suspend or delete accounts, revoke links and invitations, and end or change any part of the Service, where we reasonably believe these Terms have been breached, a legal obligation requires it, a person's safety is at risk, or the Service is being misused. We have no obligation to monitor content but may do so. You may stop using the Service and delete your account at any time from your account. Sections that by their nature should survive (including 5–7, 10–17) survive termination.

10. Third-party content, intellectual property and copyright complaints

  1. Third-party material. Event names, descriptions, images, prices and links belong to their respective owners and are shown for identification and information. Images are loaded from their original hosts and are not stored or resold by us. Third-party websites you reach from the Service have their own terms and privacy practices, which we do not control.
  2. Our material. The Service's software, design, original artwork, wordmark, editorial text, rankings and collections are owned by THIS WK or its licensors and protected by copyright, trademark and other laws. You may use them only as part of your ordinary use of the Service. Any use of the “THIS WK” name or marks requires our written permission.
  3. Copyright notices (DMCA). If you believe material in the Service infringes your copyright, send a notice to [email protected] with the subject “Copyright notice” containing: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) the URL or location of the material and enough information for us to find it; (d) your address, telephone number and email; (e) a statement that you have a good-faith belief the use is not authorized by the owner, its agent or the law; and (f) a statement, under penalty of perjury, that the notice is accurate and you are the owner or authorized to act for the owner. We will remove or disable access to material that a complete notice identifies, notify the person who posted it where possible, accept counter-notices under 17 U.S.C. §512(g), and terminate the accounts of repeat infringers. Knowingly misrepresenting infringement can make you liable for damages under 17 U.S.C. §512(f).
  4. Venues, organizers and rights holders who would like a listing corrected or removed can write to the same address; we act on such requests promptly.

11. Privacy

Our Privacy Policy explains what we collect, why, whom we share it with, how long we keep it, and your rights under the GDPR, UK GDPR, CCPA/CPRA and other laws. Our Cookie Policy explains the cookies we use and how to accept or decline optional analytics. By using the Service you acknowledge that we process your information as described there.

12. Availability, changes and beta status

The Service is offered free of charge and is a small, evolving product. We may change, suspend or discontinue any feature or the entire Service at any time, including during maintenance or when a data source becomes unavailable. We do not promise that the Service will be uninterrupted, timely, secure, error-free, or that listings will be complete, current or accurate. Where we can, we will give notice before discontinuing the Service and allow you to export your data first.

13. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE, ALL CONTENT (INCLUDING THIRD-PARTY LISTINGS, AUTOMATED EXTRACTIONS AND PERSONALIZED RECOMMENDATIONS) AND ALL GATHERINGS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE. WE MAKE NO WARRANTY ABOUT THE IDENTITY, CONDUCT, SAFETY OR RELIABILITY OF ANY MEMBER, HOST, GUEST, VENUE OR EVENT. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you; in that case the warranties are limited to the shortest period and smallest scope the law allows.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THIS WK AND ITS OWNERS, OPERATORS, CONTRIBUTORS, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR OPPORTUNITY, OR FOR PERSONAL INJURY, PROPERTY DAMAGE OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATING TO THE SERVICE, ANY LISTING, ANY GATHERING, OR THE CONDUCT OF ANY MEMBER OR THIRD PARTY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF WE WERE ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED US DOLLARS (US $100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (CURRENTLY NOTHING).

These limits do not apply to liability that cannot be limited by law, including liability for our fraud, gross negligence or willful misconduct, for death or personal injury caused by our own negligence where such exclusion is prohibited, or, for consumers in the European Economic Area or United Kingdom, to any right you have under mandatory consumer law. Some jurisdictions (including New Jersey) do not allow certain limitations; there, our liability is limited to the fullest extent the law permits. You agree that the limitations in Sections 13 and 14 are an essential basis of a free service and would be different if it were not free.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless THIS WK and its owners, operators, contributors and agents from any claim, demand, loss, liability, damage, cost or expense (including reasonable attorneys' fees) brought by a third party arising out of or relating to (a) Your Content, (b) a gathering you host or attend, (c) your breach of these Terms or of any law, or (d) your violation of anyone's rights. We may take over the defense of any matter subject to indemnification, in which case you will cooperate with us. This Section does not apply to consumers in jurisdictions where such indemnities are unenforceable.

16. Disputes: governing law, informal resolution, arbitration, class-action waiver

  1. Governing law. These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of New York and the United States, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs Section 16.3. If you are a consumer in the EEA, UK or another jurisdiction whose law gives you protections that cannot be waived by contract, you keep those protections and this Section does not take them away.
  2. Talk to us first. Before starting any formal proceeding, you and we agree to try to resolve the dispute informally: send a written description of the dispute and what you want to [email protected] (we will contact you at your account email), and allow 30 days of good-faith discussion. Any limitation period is paused during that time.
  3. Binding individual arbitration. If we cannot resolve it informally, any dispute, claim or controversy between you and THIS WK arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, before a single arbitrator. The arbitrator may award the same remedies a court could award to you individually. Hearings, if any, will take place in New York County, New York, or by video conference, unless the arbitrator decides otherwise for your convenience; you may attend by telephone or video. We will pay AAA filing, administrative and arbitrator fees to the extent required by the AAA rules or law, and we will not seek attorneys' fees from you unless the arbitrator finds your claim frivolous. If AAA is unavailable or declines to administer the arbitration, the parties will select another administrator or ask a court of competent jurisdiction to appoint an arbitrator. Judgment on the award may be entered in any court with jurisdiction.
  4. Exceptions. Either party may bring an individual claim in small-claims court in New York County or in your county of residence, and either party may seek injunctive or other equitable relief in court to stop unauthorized use or abuse of the Service or infringement of intellectual property. Nothing prevents you from bringing a matter to a government agency or, for EEA/UK consumers, to the courts or consumer-dispute bodies of your country of residence.
  5. Class-action and jury waiver. YOU AND THIS WK EACH AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING, AND EACH WAIVES ANY RIGHT TO A JURY TRIAL. The arbitrator may not consolidate claims of different people or preside over any form of representative proceeding. If this waiver is found unenforceable for a particular claim, that claim (and only that claim) proceeds in court under Section 16.7, and the remaining claims proceed in arbitration.
  6. 30-day opt-out. You may reject Section 16.3 and 16.5 by emailing [email protected] with the subject “Arbitration opt-out”, your account email and handle, within 30 days of first accepting these Terms (or of the effective date of the version that first added this Section, if you accepted an earlier version). Opting out does not affect any other part of these Terms.
  7. Courts. For any claim not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in New York County, New York, and waive any objection to venue there — except that EEA/UK consumers may sue, and may only be sued, in the courts of their country of residence.
  8. Time limit. To the extent permitted by law, any claim must be filed within one year after it arose; otherwise it is permanently barred.

17. General terms

  1. Entire agreement. These Terms, the Privacy Policy and the Cookie Policy are the entire agreement between you and THIS WK about the Service and supersede any earlier agreement.
  2. Severability. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the rest of these Terms remain in effect.
  3. No waiver. Our not enforcing a provision is not a waiver of it.
  4. Assignment. You may not assign or transfer these Terms or your account. We may assign them to a successor operator of the Service; we will post notice if we do.
  5. Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including outages of hosting, tunnelling, email or data providers, power or internet failures, weather, strikes, epidemics, government action, or the acts of third parties.
  6. No third-party beneficiaries, except that the persons released or indemnified in Sections 6, 14 and 15 may enforce those Sections.
  7. Notices from us may be posted in the Service or sent to your account email; notices to us go to [email protected].
  8. Language. These Terms are written in English; any translation is for convenience only.
  9. California residents. Under California Civil Code §1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210. The Service is provided free of charge.
